EMPLOYER'S OBLIGATIONS
The employment legislation covers all employees, including part-timers, except for:
- Close family;
- Non-executives directors;
- Trainees under youth training schemes;
- Employees working abroad;
- The self employed.
Directors as 'office-holders' are excluded unless they are clearly employees - for instance, there is a service contract.
Self-employed workers are excluded from most of the employment protection and they also have their own responsibilities under health and safety legislation.
Apprentices, students on work experience placements of up to one year for part of a graduate, postgraduate or teacher training course and employees on government-supported training or retaining programmes are not fixed term employees.
